Terms of Use
Summary
- These Terms are a contract between you and Daniil Badalov, trading as Phantom Machines, in the Czech Republic. For apps from the App Store, Apple's Licensed Application End User License Agreement also applies; these Terms supplement it.
- Where an app produces machine-generated output, that output can be wrong, incomplete or misleading. Check anything that matters before you rely on it. We are not liable for decisions made on the basis of machine output, except where the law says otherwise.
- Subscriptions and purchases are made through Apple. Apple handles payment, renewal, cancellation and refunds under its own rules.
- Paid plans include fair-use limits. Sharing an account, scripting the app, circumventing limits or reselling access can lead to a pause of the service until the next paid period and, in serious cases, termination.
- You own your content. We only get the rights needed to process it and return the result.
- We give no warranties beyond what the law requires, and our liability is limited as far as the law allows. Nothing in these Terms removes rights that consumer law gives you and that cannot be waived.
- Czech law governs; Czech courts have jurisdiction, but consumers keep the protection of their home country's law and courts where the law gives it to them.
Part A — General terms
1. Who we are and what these Terms cover
1.1 These Terms of Use ("Terms") are an agreement between you and Daniil Badalov, an individual trading as Phantom Machines, Siroka 240/2, 362 63 Dalovice, Czech Republic, email support@phantommachines.com ("we", "us", "Phantom Machines").
1.2 They cover the apps we publish (each an "App"), the online services an App connects to (the "Service"), and the website phantommachines.com. Part B contains additional rules for specific Apps. If Part B conflicts with Part A, Part B applies to that App.
1.3 "Consumer" means a natural person who uses an App for purposes outside their trade, business, craft or profession. "Business user" means anyone else. Some provisions apply differently to Consumers, because consumer law gives Consumers rights that cannot be removed by contract. Nothing in these Terms is intended to remove such rights, and any provision that would do so applies only to the extent the law allows.
1.4 Our Privacy Policy (phantommachines.com/privacy) explains how we handle data. It forms part of these Terms.
2. Acceptance
2.1 You accept these Terms by ticking the acceptance box and choosing "Agree" when an App first asks you to, and in any case by installing or using an App or the Service. If you do not agree, do not use the App; if you have bought a subscription, you may ask Apple for a refund under Apple's rules (Section 5.5).
2.2 You must be able to enter into a binding contract. If you are under the age at which you can do so in your country, a parent or guardian must agree to these Terms on your behalf and supervise your use. Our Apps are not directed at children under 13.
2.3 If you use an App on behalf of a company or another person, you confirm that you have authority to bind them, and "you" includes them.
2.4 When we change these Terms materially (Section 17), the App will ask you to accept the new version again before you continue to use it.
3. Apps downloaded from Apple's App Store
3.1 For an App obtained from Apple's App Store or Mac App Store, Apple's Licensed Application End User License Agreement (the "Apple EULA", apple.com/legal/internet-services/itunes/dev/stdeula) governs your licence to the App. These Terms supplement the Apple EULA. Where these Terms and the Apple EULA both deal with the same subject, the Apple EULA prevails as to the licence of the App itself and Apple's rights, and these Terms prevail as to the Service, subscriptions, fair use, your Content and the matters in Part B, to the extent permitted by the Apple EULA.
3.2 Apple requires the following, and you and we agree to it:
(a) Parties. These Terms are concluded between you and Phantom Machines only, not Apple. Phantom Machines, not Apple, is solely responsible for the App and its content.
(b) Scope of licence. Your licence to the App is non-transferable and limited to use on Apple-branded devices that you own or control, as permitted by the Usage Rules in Apple's Media Services Terms and Conditions, except that the App may be accessed and used by other accounts associated with you through Family Sharing or volume purchasing where Apple makes those features available.
(c) Maintenance and support. Phantom Machines is solely responsible for providing maintenance and support for the App, as described in these Terms or as required by law. Apple has no obligation whatsoever to furnish any maintenance or support services for the App.
(d) Warranty. Phantom Machines is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App to you. To the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to the App, and any other claims, losses, liabilities, damages, costs or expenses attributable to a failure to conform to a warranty are the sole responsibility of Phantom Machines.
(e) Product claims. Phantom Machines, not Apple, is responsible for addressing any claims by you or any third party relating to the App or your possession and/or use of it, including (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy or similar legislation.
(f) Intellectual property claims. If a third party claims that the App or your possession and use of it infringes that third party's intellectual property rights, Phantom Machines, not Apple, is solely responsible for the investigation, defence, settlement and discharge of the claim.
(g) Legal compliance. You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
(h) Developer contact. Questions, complaints or claims about the App should be directed to Phantom Machines at support@phantommachines.com or the postal address in Section 1.1.
(i) Third-party terms. You must comply with any applicable third-party terms when using the App.
(j) Third-party beneficiary. Apple and Apple's subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
4. Licence and intellectual property
4.1 Subject to these Terms, we grant you a personal, non-exclusive, non-transferable, revocable licence to install and use the App on devices you own or control, for your own use, and to use the Service through the App.
4.2 The Apps, the Service, their code, design, interfaces, names, logos, illustrations, text, animations and documentation are owned by Phantom Machines or its licensors and are protected by copyright, trademark and other laws. Except for the licence above and the rights that the law gives you (for example under Article 6 of Directive 2009/24/EC on decompilation for interoperability), you may not copy, modify, distribute, sell, lease, sublicense, reverse engineer, decompile, extract the source of, or create derivative works from the Apps or the Service, or remove any proprietary notice.
4.3 Feedback you send us (ideas, suggestions, bug reports) may be used by us without obligation to you. We will not claim that your feedback was ours, and feedback never includes your Content.
4.4 "Phantom Machines", the names of our Apps and our logos are our trade names and marks. You may refer to them to describe the product; you may not use them in a way that suggests endorsement.
5. Purchases, subscriptions and balance
5.1 Apple is the merchant. Subscriptions and in-app purchases are sold by Apple through its in-app purchase system. Prices, currencies, taxes, billing, receipts, renewal, cancellation and refunds are handled by Apple under Apple's Media Services Terms and Conditions. We do not receive your payment details.
5.2 Plans and what they include. Current plans, prices, included allowances and any free trial are shown in the App and on the App Store before you buy. Allowances are per billing period; unused allowance does not carry over unless the plan says so.
5.3 Auto-renewal. Subscriptions renew automatically for the same period at the then-current price unless you cancel at least 24 hours before the end of the current period. Apple charges your Apple ID payment method within 24 hours before the renewal date. If a free trial is offered, the subscription starts and payment begins when the trial ends unless you cancel before then; any unused trial period is forfeited when you buy a subscription.
5.4 Cancellation. You can cancel at any time in your Apple ID subscription settings (System Settings or the App Store app on your device, "Subscriptions"). Deleting the App does not cancel a subscription. Cancellation takes effect at the end of the current period; you keep access until then, and no partial refund is due for the remainder of the period except where Apple's rules or the law provide otherwise.
5.5 Refunds. Refund requests for App Store purchases are decided by Apple (reportaproblem.apple.com). We cannot issue refunds for purchases made through Apple. If Apple refunds or revokes a purchase, your entitlement to the related service ends at the moment of the refund and any balance or allowance that came with that purchase is removed.
5.6 Price changes. If the price of a subscription changes, Apple will notify you in advance and, where required, ask for your consent before the new price applies. If you do not agree, the subscription ends at the end of the current period.
5.7 Balance top-ups. Where an App offers one-off balance top-ups through Apple, the balance is a prepaid credit for the Service, tied to the account that bought it. It is not money, has no cash value, is not transferable, cannot be exchanged for cash, and is deducted as you use the Service at the rates shown in the App. Balance does not expire unless an expiry period is stated clearly at the point of purchase. Balance is refundable only through Apple under Apple's rules, or where the law requires.
5.8 Direct sales (if offered). We may in future sell a direct-download edition of an App on our website with a licence key. In that case: (a) the merchant and payment processor named at checkout handles payment and invoicing; (b) a licence key is personal, tied to the number of devices stated at purchase, and may not be shared, resold or published; (c) if you are a Consumer in the EU, you have the statutory 14-day right to withdraw from a distance contract, except that, for digital content delivered immediately, you lose that right once delivery has begun with your express consent and acknowledgment, which you give by activating the key or starting to use the Service; we will confirm this on a durable medium; (d) refunds and withdrawal requests should be sent to support@phantommachines.com.
5.9 Taxes and invoices. Apple issues receipts for App Store purchases. If you need an invoice for a direct purchase, contact support.
6. Fair use and limits
6.1 Plans are priced on the assumption of ordinary human use by one person on their own devices. Each plan has allowances and technical limits (for example request rate or concurrent devices) shown in the App. We may enforce them by refusing or queuing requests that exceed them.
6.2 The Service costs us money every time it is used. If the cost of an account's usage far exceeds what has been paid for the current period, or the pattern of use indicates automated, shared or scripted use, our server may pause the paid Service for that account automatically until the next paid period begins. A pause does not end your subscription and does not entitle you to a refund for the paused period, except where the pause was wrong. If you believe a pause was wrong, contact support; a human will review it and lift the pause if the use was legitimate.
6.3 We may adjust allowances, limits and rates for future billing periods. Changes that reduce what a plan includes apply only from the next renewal after you have been notified, and you may cancel before then.
7. Acceptable use; suspension and termination
7.1 You must not, and must not allow anyone else to:
(a) share an account, subscription, balance or licence key with other people, or use the App on more devices than the plan allows;
(b) access the Service by any means other than the App as we provide it, including scripts, bots, automation tools, emulators or unofficial clients, or exceed normal human use;
(c) circumvent, disable or interfere with limits, fair-use controls, entitlement checks, authentication or security features, or probe or attack our server;
(d) resell, rent, sublicense, time-share or offer the App or the Service to third parties, or use it to build a competing product;
(e) use the Service to process Content that is unlawful, that you have no right to process, or that the law forbids you to disclose to a third party (Section 8.4);
(f) use the Service to infringe others' rights, to harass, defraud or deceive, to create or spread malware, or to generate material that is illegal where you or the recipient are;
(g) use outputs to train, fine-tune or evaluate a competing model, or to systematically extract data from the Service;
(h) misrepresent machine-generated output as the work of a person or as certified or professional work.
7.2 Pause. If we reasonably believe that an account breaches Section 6 or 7.1, we may pause the paid Service for that account until the next paid period begins, with notice in the App or by email where we have one. The pause lifts automatically at the next renewal unless the breach continues.
7.3 Termination for serious abuse. For serious or repeated breaches (for example reselling access, attacking the server, systematic circumvention of limits, or processing clearly unlawful Content), we may terminate your access to the Service permanently, after giving you a chance to respond unless the circumstances make that unreasonable. A permanent termination is always a human decision. On termination your licence ends; you are not entitled to a refund for the current period, except where the law requires, and Apple's refund rules remain available to you.
7.4 Your right to end the agreement. You may stop using an App at any time and cancel subscriptions as described in Section 5.4. Consumers in the EU also have statutory rights to terminate for lack of conformity (Section 11.3).
7.5 Our right to discontinue. We may discontinue an App or the Service, or a feature, with at least 30 days' notice where reasonably possible. Prepaid periods affected by a discontinuation will be refunded pro rata through Apple or directly.
7.6 Sections that by their nature should survive (ownership, disclaimers, liability, governing law) survive termination.
8. Your Content
8.1 You own your Content. "Content" means the material you submit to an App for processing, and the outputs produced from it. We claim no ownership of your Content or of the outputs. To the extent any right in an output arises in our favour, we assign it to you on creation, or, where assignment is not possible, we license it to you without restriction.
8.2 Licence to process. You grant us, and the service providers we use to run the Service, a non-exclusive, worldwide, royalty-free licence to receive, transmit, reproduce, process and transform your Content, solely to the extent needed to produce the output you requested, to return it to you, to operate and secure the Service, and to comply with the law. The licence ends when the request has been served, except for transient copies that our providers may retain for abuse monitoring as described in the Privacy Policy. We do not use your Content for anything else, including training models.
8.3 Your responsibility for Content. You are responsible for your Content. You confirm that you have the rights, consents and legal basis needed to submit it for processing, including where it contains personal data about other people, copyrighted material, or messages written by others.
8.4 Confidential, regulated and third-party data. You decide what to submit. Some information is subject to rules that restrict disclosure to third parties or transfer abroad, for example professional secrecy (lawyers, doctors, banks), classified or export-controlled data, payment-card data under card-scheme rules, data covered by a non-disclosure agreement, or health data under laws such as HIPAA. Our Service is a general-purpose consumer and small-business tool and is not certified for such regimes. Do not submit Content that you are not permitted to transmit to a general-purpose cloud service; if you do, you do so on your own responsibility. The Privacy Policy explains, truthfully and in detail, where Content goes and for how long it may exist.
8.5 Content we will not process. We may refuse or stop processing Content that is unlawful or that breaches Section 7.1, as far as we become aware of it (we do not read Content; automated safety systems of our providers may reject some requests).
9. Machine-generated output
9.1 Some Apps produce output automatically, including with AI models operated by a third-party provider; each App's section in Part B says whether it does and what kind of output it produces. Such output is generated by software, not reviewed by a person, and is provided for your convenience. It can contain errors, omissions and invented details, and it can read as confident while being wrong.
9.2 You must check output before relying on it. Output is not a substitute for professional advice or for checking the source. Before using an output for anything that matters, check it against the source and, where the stakes justify it, have it checked by a qualified person.
9.3 Not for critical uses. The Service is not designed, tested or licensed for, and must not be used as the sole basis for: medical diagnosis or treatment; legal, tax or financial decisions; safety-critical, emergency or life-saving communication; operation of critical infrastructure, vehicles, weapons or medical devices; or any decision that produces legal or similarly significant effects on a person without human review. Do not rely on the Service in an emergency; contact the emergency services.
9.4 Decisions are yours. To the fullest extent the law allows, we are not responsible for decisions, actions, omissions, transactions, submissions, statements or losses that you or anyone else make or suffer in reliance on output, and the limitations in Section 11 apply to any claim relating to output. Part B contains additional rules for specific kinds of output.
10. Availability and changes to the Service
10.1 The Service depends on networks, Apple's platforms and third-party providers. We aim for high availability but do not promise that the Service will be uninterrupted, error-free or available at any particular time, and we may suspend it temporarily for maintenance, security or reasons outside our control.
10.2 We may change, improve or remove features, models and providers over time. Where a change materially reduces the Service for a Consumer in the EU during a paid period, the Consumer may terminate the contract within 30 days of being informed and receive a pro rata refund of the prepaid price for the remaining period (through Apple where the purchase was made through Apple).
10.3 We provide updates to keep the App working with current operating systems and to fix security issues for as long as a Consumer may reasonably expect, and at least for the duration of any paid period. Install updates when offered; we are not responsible for problems caused by failure to install an update we have provided.
11. Warranties and statutory rights
11.1 What the Service is. Each App and the Service have the characteristics described in Section 9 and in that App's section of Part B. A result that is imperfect or incomplete is a normal characteristic of automated output and does not, by itself, mean that the Service lacks conformity with the contract. Conformity is to be assessed against this description, which you have been specifically informed of and have expressly accepted.
11.2 No other warranties. To the fullest extent permitted by applicable law, and subject to Section 11.3, the Apps and the Service are provided "as is" and "as available", and we disclaim all warranties, conditions and representations, express or implied, including implied warranties of merchantability, fitness for a particular purpose, accuracy, completeness, non-infringement and uninterrupted availability. In particular, we do not warrant that any output will be accurate, complete, fit for any particular purpose, preserve the layout or formatting of an original, or be accepted by any authority, counterparty or third party. Some jurisdictions do not allow the exclusion of implied warranties, so some of the above exclusions may not apply to you.
11.3 Consumer statutory rights are preserved. If you are a Consumer, you have statutory rights regarding the conformity of digital content and digital services (in the EU under Directive (EU) 2019/770 and the laws implementing it, for example Sections 2389a et seq. of the Czech Civil Code, and in the Czech Republic Act No. 634/1992 Coll. on Consumer Protection; in other countries under their consumer laws), including remedies for lack of conformity for the duration of the supply. Nothing in these Terms limits those rights. If the Service does not conform to the contract, contact support@phantommachines.com; you may also notify Apple, which will refund the purchase price under Section 3.2(d).
11.4 Business users. If you are a Business user, your sole and exclusive remedy for any non-conformity of the Service is, at our option, re-performance of the affected request or a refund of the fees attributable to the affected period, and Section 11.3 does not apply to you.
12. Limitation of liability
12.1 What we do not limit. Nothing in these Terms excludes or limits our liability for:
(a) death or personal injury caused by our negligence;
(b) harm caused intentionally or by gross negligence;
(c) fraud or fraudulent misrepresentation;
(d) harm to a person's natural rights (personality rights) within the meaning of Czech law;
(e) any liability that cannot be excluded or limited under the law applicable to you, including, for Consumers, mandatory consumer-protection and digital-content conformity rules, and, under Czech law, the rule that a weaker party's right to compensation cannot be excluded or limited in advance (Section 2898 of the Czech Civil Code).
Where a limitation below would conflict with any of the above, it applies only to the extent it does not.
12.2 Excluded losses. Subject to Section 12.1, we are not liable for: loss of profit, revenue, business, contracts, opportunity or anticipated savings; loss of or damage to data (other than as a direct result of our breach); business interruption; loss of goodwill or reputation; fines, penalties, interest or costs imposed on you by third parties or authorities; losses caused by reliance on output (Section 9); losses caused by Content you submitted in breach of Section 8; or any indirect, incidental, special, consequential, exemplary or punitive loss, in each case whether arising in contract, tort (including negligence), breach of statutory duty or otherwise, and even if we were advised of the possibility of such loss.
12.3 Cap. Subject to Sections 12.1 and 12.2, our total aggregate liability to you arising out of or in connection with the Apps, the Service, these Terms or any output, in any 12-month period, is limited to the greater of (a) the total amount you paid for the Service in the 12 months before the event giving rise to the claim and (b) EUR 50.
12.4 Causes beyond our control. We are not liable for failures caused by events beyond our reasonable control, including outages of Apple services, networks, hosting or AI providers, denial-of-service attacks, legal or regulatory action, or changes to third-party platforms.
12.5 Your own measures. You are responsible for keeping copies of your originals and outputs, for reviewing output before use (Section 9), and for configuring your device and permissions appropriately.
12.6 Fair allocation. The limitations in this Section reflect the low price of the Service compared with the value of the Content that may pass through it and the fact that we cannot know or control how output is used. The price would be higher without them.
12.7 Jurisdictional notice. Some jurisdictions do not allow the exclusion or limitation of certain damages; in those jurisdictions our liability is limited to the greatest extent permitted by law. If you are a Consumer in the EU or the UK, the provisions of this Section apply only to the extent permitted by the mandatory law of your country of residence.
13. Indemnity
13.1 If you are a Business user, you will defend and indemnify us against third-party claims, and the resulting losses and reasonable costs, arising from your Content, your breach of Sections 7 or 8, or your use of output in breach of these Terms, except to the extent caused by our own breach, negligence or wilful misconduct.
13.2 If you are a Consumer, Section 13.1 does not apply. You remain liable, under the general law, for loss you cause us by unlawful use of the Service or by submitting Content you had no right to submit, but only to the extent the law of your country of residence allows.
14. Governing law and disputes
14.1 Governing law. These Terms and any dispute arising from them or from the use of an App are governed by the law of the Czech Republic, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. If you are a Consumer, you also enjoy the protection of the mandatory provisions of the law of the country in which you habitually reside, and nothing in this Section deprives you of that protection.
14.2 Talk to us first. If you have a problem, email support@phantommachines.com describing it. We will try to resolve it within 30 days. Both sides agree to attempt resolution in good faith before starting formal proceedings, without this limiting a Consumer's right to go to court or to a consumer body at any time.
14.3 Courts. The courts of the Czech Republic have jurisdiction over disputes arising from these Terms. If you are a Consumer, this does not deprive you of the right to bring proceedings in, or to be sued only in, the courts of your country of residence where the law gives you that right (for example Articles 17–19 of Regulation (EU) 1215/2012 for EU residents). Small claims may be brought in the small-claims court of your place of residence where that court has jurisdiction.
14.4 Consumer dispute resolution (EU / Czech Republic). A Consumer in the Czech Republic may use out-of-court dispute resolution through the Czech Trade Inspection Authority (Česká obchodní inspekce, Ústřední inspektorát – oddělení ADR, Štěpánská 796/44, 110 00 Praha 1, www.coi.cz, adr.coi.cz), or through another body registered by the Czech Ministry of Industry and Trade. Consumers in other EU countries may contact the alternative dispute resolution body competent in their country; the European Consumer Centres Network (eccnet.eu) can help identify it. (The EU's online dispute resolution platform was discontinued in July 2025.) Participation in ADR is voluntary for us unless the law makes it mandatory, but we will consider every request in good faith.
14.5 No arbitration clause. These Terms do not require arbitration and do not waive class or representative actions. Each party keeps the rights that the law of the applicable forum gives it.
14.6 Time limit for Business users. A Business user must bring any claim against us within one year after the event giving rise to it, to the extent the law allows such a limit.
15. Export compliance and sanctions
You must comply with applicable export-control and sanctions laws when using the Apps and the Service and must not use them in, or for the benefit of anyone in, a country or on a list where that is prohibited (see also Section 3.2(g)).
16. Website
The website phantommachines.com is provided for information. Its content may be out of date or contain errors and is provided without warranty. Links to third-party sites are provided for convenience; we do not control or endorse them.
17. Changes to these Terms
17.1 We may change these Terms when the Apps, the Service, our providers or the law change, or to correct errors. The effective date at the top shows the current version; previous versions are available on request.
17.2 Material changes (for example to prices, allowances, your rights, liability or dispute rules) will be announced at least 30 days before they take effect, by a notice in the App or on the website, and the App will ask you to accept the new version. If you do not accept, you may continue to use the App under the old Terms until the end of your current paid period and then stop using it; you may cancel the subscription so that it does not renew. Using the App after the change takes effect, or accepting the new version in the App, means you agree to it. Material changes do not apply retroactively to a paid period that has already started unless they are only to your benefit or required by law.
17.3 Minor changes (typographical corrections, clarifications that do not reduce your rights, new app sections in Part B that do not affect apps you use) take effect when published.
18. General
18.1 Entire agreement. These Terms, the Privacy Policy and (for App Store apps) the Apple EULA are the entire agreement between you and us about the Apps and the Service and replace any earlier terms.
18.2 Severability. If any provision is held invalid or unenforceable, it will be enforced to the maximum extent permissible and the remaining provisions remain in full force. A provision held invalid as against Consumers remains valid as against Business users, and vice versa.
18.3 No waiver. Our failure to enforce a provision is not a waiver of it.
18.4 Assignment. You may not transfer your rights under these Terms. We may transfer our rights and obligations to a successor who takes over an App, provided your rights are not reduced; we will notify you.
18.5 Notices. We may notify you in the App, on the website or by email if you gave us one. You may notify us at support@phantommachines.com or the postal address in Section 1.1.
18.6 Language. These Terms are drafted in English. Translations are for convenience; the English text governs. The contract is concluded in English.
18.7 Headings and summaries are for convenience and do not affect interpretation. The Summary at the top is not a substitute for the full text, but may be used to understand our intentions.

Part B — App-specific terms
Each app we publish has its own section here. If an app is not listed, Part A applies to it in full.
B1. Briz (macOS)
B1.1 What Briz does
Briz is a macOS app for voice translation and dictation, translation of selected text, translation of documents (PDF, Word, Excel, PowerPoint), translation of web pages, and live translation of chat messages ("Live-chat"). Briz sends your Content to our Service, which uses third-party AI models to transcribe and translate it, and returns the result to your Mac, including by pasting it where your cursor is if you enable that. Some features may fall back to Apple's on-device speech and translation frameworks. In Briz, your Content is the audio, text, documents, web pages and chat messages you submit.
B1.2 Nature of Briz output
Everything Briz produces is machine-generated, in the sense of Section 9 of Part A. Any output can contain errors, including mistranscribed words, mistranslated or omitted sentences, wrong numbers, dates, names, amounts, units, negations or legal terms, invented words, and formatting changes; it can be fluent and confident while being wrong. It is not a substitute for a professional, certified or sworn translation or for reading the original, and a result that differs from what a human translator would produce is a normal characteristic of this kind of service. In addition, you acknowledge the following specific characteristics of Briz, which form part of the description of the Service for the purposes of Section 11.1:
(a) Speech recognition can mishear words, especially names, brands, numbers, addresses, technical terms, words in a language other than the one being spoken, speech in noisy environments or over poor microphones, and accents it has not been trained on. Briz may apply a style (for example "business") that changes wording, register or formality.
(b) Translation is produced by language models that aim for natural, fluent text, not a word-for-word rendering. Nuance, tone, ambiguity, idioms, humour, legal and technical terminology, and culturally specific references may be lost or changed. The model may occasionally omit, add or reorder information, or produce text that reads convincingly but does not match the original.
(c) Language detection is automatic and can be wrong for short, mixed-language or similar-language inputs; a translation may then be produced from or into the wrong language.
(d) Automatic pasting inserts output into another app at the cursor position. Where the receiving app does not report reliably what it received, Briz may be unable to confirm delivery; it is designed never to paste twice rather than risk a duplicate, so you may need to paste manually. You are responsible for what you send from other apps after Briz has pasted into them.
(e) Live-chat translates messages in near real time and inherits all of the above; both sides of a conversation should be aware that they are communicating through machine translation.
B1.3 Document translation — important terms
Briz can translate whole documents, including documents that matter: invoices, bank statements, contracts, certificates, official letters, medical and technical papers. Because of that, the following applies in addition to Sections 9, 11 and 12 of Part A:
(a) A machine translation of a document is an aid to understanding it, not a replacement for it. It is not a certified, sworn, official or professional translation, is not reviewed by any person, and is not suitable for submission to courts, authorities, banks, insurers, employers, universities or counterparties as a translation of the original, unless the recipient has expressly accepted a machine translation.
(b) Any element of a translated document may be wrong. This includes amounts, currencies, account and reference numbers, dates, deadlines, names, addresses, units of measurement, dosages, legal terms, definitions, conditions, exclusions, negations, cross-references, headings and footnotes. A single mistaken word (for example "unless" for "if", or a shifted decimal point) can reverse the meaning of a clause or a figure. Treat every number and every condition in a translated document as unverified until you have compared it with the original.
(c) Layout and structure may change. Translated text is usually longer or shorter than the original; Briz re-flows and resizes text and may change line breaks, page breaks, fonts, column widths, table alignment, headers, footers, captions, text in images, and the position of stamps, signatures and QR codes. Spreadsheets: formulas, cell references, number formats and data validation may be altered or broken by translating cell text. Presentations: text may overflow or be clipped. Scanned or image-based pages may be partly or wholly untranslated. Always keep the original file; Briz saves the translation as a separate copy.
(d) Before relying on a translated document, you must (i) read it against the original; (ii) verify every figure, date, name and condition that matters; and (iii) for anything with legal, financial, medical, safety or official consequences, obtain a professional human translation or advice from a qualified person. We recommend that translated documents be used to decide whether and where professional help is needed, not as the basis for the final decision.
(e) We are not a translation agency. We do not review, certify, proofread or take responsibility for the accuracy, completeness or fitness of any translated document. To the fullest extent permitted by applicable law and subject always to Section 12.1 of Part A, we accept no liability for any loss, cost, penalty, missed deadline, tax, fine, lost claim, incorrect payment, contractual consequence or other damage arising from the use of, reliance on, submission of or failure to verify a machine-translated document, and any such claim is subject to the exclusions and the cap in Section 12.
(f) Confidential documents. Documents such as bank statements, contracts and medical records often contain personal data of other people and information subject to confidentiality obligations. Section 8.4 applies. The Privacy Policy describes exactly where document Content travels (to our server and to our AI provider, over encrypted connections), that we do not store it, and that the provider may retain it for up to 30 days for abuse monitoring. If that path is not acceptable for a given document, do not translate it with Briz.
(g) Statutory rights unaffected. For Consumers, nothing in this Section B1.3 limits the rights described in Section 11.3 or the liability that cannot be limited under Section 12.1. Because machine translation with the characteristics described above is what the Service is, an error of the kind described in this Section is not, by itself, a lack of conformity.
B1.4 Plans, allowances and balance
Briz offers auto-renewable subscriptions and one-off balance top-ups through Apple (Section 5). Allowances are expressed in minutes of recorded audio and in characters of text processed per billing period, as shown in the App. "Minutes" are minutes of recording, including pauses, not minutes of speech. Document, web-page and Live-chat translation count against character allowances or balance at the rates shown in the App. Allowances reset at each renewal and do not carry over. Fair-use pausing (Section 6) applies.
B1.5 Permissions and system integration
Briz needs Microphone access to record dictation and Accessibility access to paste translations into other apps. These permissions are granted and withdrawn by you in macOS. Briz uses Accessibility only to insert text and to determine where to insert it. We are not responsible for the behaviour of other apps into which Briz pastes text, or for text you send from those apps.
B1.6 Direct-download edition (if offered)
If a direct-download edition of Briz is offered with licence keys, Section 5.8 applies. The same Service, fair-use rules and Part B terms apply to both editions.
